afan Terms of Service

afan is a service for sharing photos, supporting creators and selling artworks, provided by Common Computer Inc. (“Common Computer”, “we”, “us”). These Terms of Service (the “Terms”) apply to the afan website, apps and related services (the “Services”). By using the Services you agree to these Terms. If you do not agree, do not use the Services.

1. Who can use afan

You must be at least 13 years old to use the Services, and old enough in your country to enter into a binding contract to make or receive payments. You may not use the Services if you are barred from doing so under the laws of the Republic of Korea, the United States or any other applicable jurisdiction, including sanctions laws. If you use the Services for a business, you confirm that you may accept these Terms on its behalf.

2. Your account, wallets and signatures

You can sign in in two ways:

  • With a wallet (for example Coinbase Smart Wallet or MetaMask). To prove that you control the wallet address, you sign a short message. Signing this message is free and does not send a transaction. Your wallet address becomes your account identifier and is public.
  • With AinDrive, a cloud drive service on AI Network. AinDrive’s own terms apply to your AinDrive account.

Your wallet and its keys are yours alone. We never hold your keys and never ask for your recovery phrase; anyone who asks for it on our behalf is not us. We cannot recover a lost wallet, reverse a transaction you approved, or restore access to an account whose wallet or AinDrive account you no longer control.

You are responsible for what happens in your account. Keep your wallet and devices secure, and do not create an account for someone else, share an account, or sell or transfer your account or username without our written permission.

3. FANCO and payments

FANCO is a token on the Base network. In afan you can use FANCO to tip creators (“crushOn”), pay for ads, buy artworks in the Shop and buy storage packs. The FANCO smart contract on Base is linked from the footer of every page.

  • Every payment is a blockchain transaction that you approve in your own wallet. FANCO moves directly from your wallet to the recipient (and, where a fee applies, to the fee wallet) through a payment contract. afan never holds your FANCO.
  • Blockchain transactions are final. We cannot cancel, reverse or refund an on-chain payment. Check the amount and the recipient before you confirm. Network fees (“gas”) may apply and are not refundable.
  • FANCO is a means of payment inside the Services. It is not an investment, and we make no promise about its price, liquidity or future value. Using FANCO or any feature of afan gives you no share in the profits of any creator, of afan or of Common Computer.
  • You are responsible for any taxes that apply to payments you make or receive.

4. Platform fee

When fans pay a creator in FANCO (tips, ad payments and Shop sales), afan keeps a platform fee, currently 5% of the amount. The fee is 0% when the creator has linked their own AinDrive to their afan account. The fee is taken on-chain, in the same transaction as the payment, and the creator receives the rest. Storage packs are paid to afan in full. We may change the fee for future payments; we will show the fee that applies before you pay, and the payment contract never allows more than 20%.

5. Storage

  • Your own AinDrive. If you link AinDrive with permission to write to your drive, the files you upload are saved in your own drive. They stay under your control and AinDrive’s terms apply to them. If you delete or move them in AinDrive, they may no longer display in afan.
  • afan storage. Without AinDrive, your files are kept in afan storage, which gives every account a free allowance. You can buy storage packs with FANCO. Packs are one-time purchases: they do not expire, they add up, and they are not refundable or transferable. Uploads that would exceed your quota are refused. We may limit the size or type of files.

6. The Shop

Artists can offer artworks for sale in the Shop tab of their profile.

  • Sold from the artist’s AinDrive. The listing is a paid share in the artist’s own drive, and the payment is settled by AinDrive to the artist’s payout wallet. AinDrive’s terms apply to the sale.
  • Sold from afan storage. The original is stored in afan storage and counts toward the artist’s storage quota. The buyer pays in FANCO through the payment contract, and the platform fee applies.
  • After the payment is confirmed, the buyer can download the file. Unless the artist says otherwise, the buyer gets a personal, non-exclusive license to download, keep and view the artwork, and the artist keeps the copyright. Buying an artwork does not give the right to resell it or use it commercially.
  • The artist promises that they own the artwork or have the right to sell it, and that it matches its description. The sale is between the buyer and the artist. Because payments are on-chain, there are no refunds through afan; if something is wrong, contact the artist or write to us and we will help where we can. We may remove any listing that breaks these Terms.

7. Your content

You keep the rights you have in the photos, text and other content you post (“your content”). You give Common Computer a worldwide, royalty-free, non-exclusive license to host, store, copy, display, adapt (for example, resize) and distribute your content, only to operate, improve and promote the Services. The license ends when you delete your content, except for copies that others have already received and records that cannot be erased (see below).

Posts, comments, likes, follows, your profile and payment records are written to the AIN blockchain, and payments are also recorded on the Base blockchain. Blockchain records are public, and earlier versions can remain in the blockchain’s history after you edit or delete something in afan. Do not post anything you would not want to be public and permanent. Our Privacy Policy explains this in more detail.

You are responsible for your content and promise that you have the rights to post it. If you send us feedback, we may use it without owing you anything.

8. Rules for using afan

You may not use the Services to:

  • infringe anyone’s copyright, trademark, privacy, publicity or other rights;
  • bully, harass, threaten, defame or impersonate anyone;
  • post sexual content involving minors, pornography, graphic violence, hate speech or incitement to violence;
  • spam, scam or defraud others, or promise returns or profits to other users;
  • create fake accounts, or abuse invites, rewards, tips or the Shop;
  • scrape the Services, interfere with them, probe their security, or get around limits, quotas or content filters;
  • upload malware, or use another person’s account or wallet without permission;
  • break any law, or help anyone else do any of these things.

9. Reporting and enforcement

You can report a post from its ⋯ menu, hide posts from your feed and block other users. We review reports and may remove content, remove listings, limit features or suspend or close accounts that break these Terms, with or without notice. We cannot change or remove records on a blockchain, but we can stop showing them in afan. Copyright complaints follow our Copyright Policy.

10. Ads and invites

The Services may show ads, including ads that users pay for. Invite rewards and other promotions are offered at our discretion, may have their own conditions, and may change or end at any time. We may cancel rewards obtained through fake accounts or other abuse.

11. Third-party services

afan works with services we do not control, including AinDrive, the Base network, wallet apps and block explorers. Their terms and privacy policies govern your use of them, and we are not responsible for them, for their availability, or for losses caused by them or by the blockchains they run on.

12. Changes and termination

We may add, change or remove features, or suspend or stop the Services. We may update these Terms; when a change is significant we will tell you in the Services before it takes effect, and continuing to use the Services means you accept the updated Terms. You can stop using afan at any time and ask us to close your account by writing to help@afan.ai. Storage packs and payments already made are not refunded when an account closes.

13. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND TO THE EXTENT PERMITTED BY LAW, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES, ANY BLOCKCHAIN, WALLET OR STORAGE WILL BE SECURE, ERROR-FREE OR AVAILABLE, OR THAT ANY CONTENT OR FILE WILL BE PRESERVED. WE ARE NOT RESPONSIBLE FOR CONTENT THAT USERS OR THIRD PARTIES POST, SELL OR SEND.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMMON COMPUTER AND ITS AFFILIATES, DIRECTORS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, TOKENS, DATA OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES, TRANSACTIONS YOU APPROVE, THE CONDUCT OF OTHER USERS, OR THIRD-PARTY SERVICES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF USD 100 OR THE PLATFORM FEES AND STORAGE PACKS YOU PAID US IN THE LAST 12 MONTHS. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

15. Indemnity

To the extent permitted by law, you will indemnify Common Computer against claims, losses and costs (including reasonable legal fees) arising from your content, your sales in the Shop, your breach of these Terms or your violation of anyone’s rights.

16. Governing law

These Terms are governed by the laws of the Republic of Korea. Common Computer operates the Services from Korea; if you use them elsewhere, you are responsible for following your local laws. Mandatory consumer protections of your country of residence still apply.
